Innocent Spouse |
When you file a joint return with your spouse, both of you become 100% responsible for the tax liability on that return. That means IRS can come after you, individually, for 100% of the outstanding balance on a joint return—not just your half. However, if your spouse or ex-spouse understated the tax on a jointly filed return, you may qualify to be released from obligation for the understated tax and the related interest and penalties. This is called Innocent Spouse Relief. In order to qualify for this relief, you must apply within two years of the date IRS began trying to collect the tax from you. You must also show that the understatement of tax was attributable to your spouse and that you had no reason to know of the understatement. We have the experience needed to process innocent spouse claims. We will prepare all the necessary forms and negotiate directly with the IRS on your behalf.
